DIAMOND DANCE COMPLEX

STUDIO RENTAL AGREEMENT, ASSUMPTION OF RISK, LIABILITY WAIVER & HOLD HARMLESS AGREEMENT

1. Rental Agreement

I understand that I am renting space at Diamond Dance Complex (“DDC”) for the date and time specified in my reservation.

My rental period includes all setup, activity, breakdown, and cleanup time. I agree that I and my guests will enter and leave the facility only during the approved rental period unless otherwise authorized by DDC.

I understand that the rental is not confirmed until all required payments have been received.

Additional time beyond the reserved rental period may result in additional rental charges.

2. No DDC Staff On-Site

I understand and acknowledge that Diamond Dance Complex staff may not be present on-site during my rental.

I accept responsibility for the facility and for the conduct and safety of myself, my participants, students, clients, guests, instructors, employees, contractors, and invitees during my rental period.

I understand that renting the facility does not include supervision, instruction, security, or monitoring by DDC unless specifically agreed to in writing.

3. Facility Access & Door Code

DDC may provide me with a temporary access code or other means of entering the facility. I agree that:

• The access code is for my authorized rental only.
• I will not share the code with unauthorized individuals.
• The code may only be used during my approved rental period.
• I will not permit individuals unrelated to my rental to enter the facility.
• I am responsible for ensuring that the facility remains secure during my rental.

I understand that misuse or unauthorized sharing of an access code may result in immediate termination of rental privileges.

4. Cleaning & Condition of Facility

I agree to leave the studio and all areas I use clean, organized, picked up, and in the same condition in which I found them. Before leaving, I agree to:

• Remove all trash, decorations, personal belongings, equipment, and other items brought into the facility.
• Return any DDC equipment, furniture, or other property to its original location.
• Clean up any spills, debris, or mess created during my rental.
• Leave dance rooms, common areas, bathrooms, and other areas used in clean condition.
• Ensure that no damage has been caused to floors, mirrors, walls, equipment, furniture, or other DDC property.
• Set the air conditioning back to 78°F before leaving, if it was adjusted during the rental.

If the facility requires additional cleaning because of my rental, I understand and agree that I may be charged a $100 cleaning fee.

5. Food & Beverages

Food is not permitted inside the dance rooms. Only closed water bottles are permitted inside dance rooms unless DDC has provided prior written authorization for an exception. I am responsible for ensuring that my guests comply with this policy.

6. Securing the Facility

Before leaving, I am responsible for ensuring that all interior and exterior doors are completely closed and locked and that the facility is properly secured.

I understand that this responsibility applies even if I did not personally unlock or open a particular door. I agree to check the facility before departure and verify that all exterior doors are secure.

If I fail to properly close and lock the facility when leaving, I understand that Diamond Dance Complex may permanently revoke my future rental privileges.

7. Guests & Participants

I am responsible for the conduct of every individual I bring into or permit to enter the facility in connection with my rental.

I agree to ensure that all participants, students, clients, guests, instructors, employees, contractors, and invitees follow DDC facility rules.

I understand that every participant or guest participating in activities at DDC must complete any required Diamond Dance Complex Liability Waiver, Assumption of Risk & Hold Harmless Agreement before participating. For minors, the required waiver must be completed by a parent or legal guardian.

I agree not to knowingly allow an individual who has not completed a required waiver to participate in activities during my rental.

8. Assumption of Risk

I understand that dance, fitness, yoga, Pilates, rehearsals, private instruction, classes, training, workshops, events, and other physical activities involve inherent risks.

These risks may include, but are not limited to, slips, trips, falls, collisions, strains, sprains, fractures, injuries caused by physical exertion, and other injuries.

I voluntarily choose to rent and use the Diamond Dance Complex facility and knowingly assume the inherent risks associated with my activities and use of the premises.

I am responsible for determining whether the activities conducted during my rental are appropriate for me and my participants.

9. Release of Liability

To the fullest extent permitted by Florida law, I, on behalf of myself and my heirs, representatives, successors, and assigns, release Diamond Dance Complex, its owners, members, officers, employees, instructors, contractors, agents, affiliates, landlords, and representatives from claims arising from ordinary negligence associated with my use of the facility or participation in activities during my rental.

This release is not intended to waive any claim or liability that cannot legally be waived under applicable law.

10. Hold Harmless & Indemnification

To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless Diamond Dance Complex and its owners, members, officers, employees, instructors, contractors, agents, affiliates, landlords, and representatives from claims, demands, damages, liabilities, losses, judgments, costs, or expenses arising out of or related to:

• My use of the facility;
• Activities conducted during my rental;
• My acts or omissions;
• The acts or omissions of my participants, students, clients, guests, employees, instructors, contractors, or invitees;
• Damage to DDC property caused during my rental; or
• My failure to comply with this agreement or DDC facility rules,

except to the extent caused by conduct for which liability cannot legally be waived, released, or shifted under applicable law.

11. Independent Rental / No DDC Affiliation

Unless expressly stated otherwise in writing by Diamond Dance Complex, I understand that any class, lesson, training session, workshop, event, or activity I conduct at the facility is independently operated by me and is not a Diamond Dance Complex class, program, or event.

I will not represent or imply that I, my business, my class, or my activity is sponsored, operated, endorsed, employed, or supervised by Diamond Dance Complex without prior written authorization.

12. Damage to Property

I accept responsibility for damage to DDC property caused by me or by individuals associated with my rental beyond ordinary wear and tear. This includes, but is not limited to, damage to:

• Dance floors
• Marley flooring
• Mirrors
• Walls
• Doors and locks
• Bathrooms
• Furniture
• Audio/visual equipment
• Fixtures
• Decorations
• Studio equipment
• Other DDC property

I understand that I may be responsible for the reasonable cost of repairing or replacing property damaged during my rental.

I agree to immediately notify DDC of any damage, accident, injury, security issue, or other significant incident occurring during my rental.

13. Personal Property

I understand that Diamond Dance Complex is not responsible for lost, stolen, misplaced, or damaged personal property brought onto the premises by me or my guests. I am responsible for removing all personal property at the conclusion of my rental.

14. Medical Emergencies

I understand that DDC staff may not be present during my rental. In the event of an emergency, I am responsible for contacting 911 or appropriate emergency personnel when necessary.

I understand that I am responsible for maintaining appropriate emergency contact information for participants under my supervision.

15. Compliance with Laws & Facility Rules

I agree to conduct my rental activities in a safe and lawful manner and comply with applicable laws, regulations, occupancy requirements, and Diamond Dance Complex facility policies.

Unsafe, illegal, disruptive, destructive, or inappropriate conduct may result in immediate termination of the rental without refund and/or loss of future rental privileges.

16. Cancellation or Termination of Rental

DDC reserves the right to terminate a rental if the renter or any guest violates this agreement, creates an unsafe condition, damages the facility, engages in unlawful activity, or fails to follow DDC policies. Serious violations may result in the permanent loss of future rental privileges.

17. Acknowledgment & Agreement

I acknowledge that I have carefully read this Studio Rental Agreement, Assumption of Risk, Liability Waiver & Hold Harmless Agreement and understand its contents.

I understand that this agreement contains important provisions regarding responsibility for the facility, assumption of risk, release of certain legal claims, indemnification, cleaning requirements, security requirements, and responsibility for my guests.

I understand that DDC staff may not be present during my rental and that I am accepting responsibility for properly using, maintaining, and securing the facility during my reserved rental period.

I understand that:

• I must leave the facility clean and in the condition in which I found it.
• I may be charged a $100 cleaning fee if additional cleaning is required.
• I must ensure all exterior doors are closed and locked before leaving.
• Failure to properly secure the facility may result in permanent loss of my rental privileges.
• I am responsible for ensuring that my participants and guests comply with DDC rules and complete required liability waivers.

By signing below, I voluntarily agree to all terms and conditions contained in this agreement.

DIAMOND DANCE COMPLEX

RELEASE OF LIABILITY AGREEMENT

At Diamond Dance Complex (“DDC”), our mission is to provide exceptional dance education in a safe, encouraging, and professional environment. Every reasonable effort is made to maintain safe facilities, provide qualified instruction, and promote injury prevention through proper technique, conditioning, supervision, and age-appropriate training. However, no activity involving physical movement can be made entirely risk-free.

In consideration for being permitted to participate in any program, class, rehearsal, recital, competition, convention, workshop, camp, private lesson, performance, or other activity offered by Diamond Dance Complex, I, on behalf of myself and/or my minor child, voluntarily agree to the following:

Release of Liability

I hereby release, waive, discharge, and agree to hold harmless Diamond Dance Complex, its owners, directors, instructors, choreographers, coaches, assistants, employees, volunteers, guest instructors, independent contractors, agents, landlords, facility owners, affiliates, sponsors, and representatives (collectively referred to as the “Released Parties”) from any and all claims, demands, causes of action, liabilities, damages, judgments, costs, expenses, attorney’s fees, or losses of any kind that may arise out of or relate to participation in any Diamond Dance Complex activity, except where prohibited by law or where such injury results from gross negligence, reckless conduct, or intentional misconduct.

This release applies to any injury, illness, property damage, loss, or other harm occurring before, during, or after participation in any studio activity, whether occurring on studio premises or at any off-site location, including but not limited to theaters, competition venues, convention facilities, schools, community events, outdoor performances, or any location where Diamond Dance Complex activities are conducted.

Acknowledgment of Responsibility

I understand that Diamond Dance Complex cannot guarantee my child’s safety at all times and cannot eliminate every potential hazard associated with athletic participation.

I acknowledge that my child has a responsibility to:

• Follow all instructor directions and safety rules.
• Participate only in activities appropriate for their skill level.
• Notify instructors immediately of any injury, pain, illness, dizziness, or physical concern.
• Wear required dance attire and footwear.
• Conduct themselves in a safe and respectful manner toward instructors and fellow dancers.

I understand that failure to follow studio policies or instructor directions may increase the risk of injury.

Medical Responsibility

I acknowledge that Diamond Dance Complex does not provide medical insurance for participants.

I understand that I am solely responsible for maintaining adequate medical and health insurance coverage for my child and for paying any expenses associated with emergency treatment, physician care, hospitalization, rehabilitation, physical therapy, medications, or any other medical services related to participation.

Property Responsibility

I understand that Diamond Dance Complex is not responsible for lost, stolen, or damaged personal property, including but not limited to:

• Cell phones
• Jewelry
• Dance shoes
• Costumes
• Makeup
• Dance bags
• Electronic devices
• Personal belongings brought to the studio or any event

I accept full responsibility for my child’s personal property.

Off-Site Activities (i.e. Dance Conventions and/or Dance Competitions)

I understand that Diamond Dance Complex may participate in:

• Dance competitions
• Conventions
• Performances
• Community events
• Master classes
• Workshops
• Special events

I acknowledge that these activities involve additional risks associated with travel, unfamiliar facilities, weather conditions, crowds, transportation, lodging, and venues not owned or controlled by Diamond Dance Complex.

I agree that this Release of Liability applies equally to these off-site activities.

Independent Medical Decisions

I understand that Diamond Dance Complex instructors and staff are not medical professionals and cannot diagnose injuries or illnesses.

Any recommendation made by studio personnel regarding participation, rest, or medical attention is based solely on observation and should not replace the advice of a licensed healthcare provider.

Parent Responsibility

I agree to promptly inform Diamond Dance Complex of:

• Any changes to emergency contact information.
• Any medical conditions, allergies, medications, or injuries.
• Any restrictions placed on my child by a healthcare provider.

I understand that withholding relevant medical information may increase the risk of injury.

Continuing Agreement

I understand that this Release of Liability remains in effect throughout my child’s enrollment at Diamond Dance Complex and applies to all future participation unless a revised agreement is executed.

If any portion of this agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Acknowledgment

By signing below, I certify that:

• I have carefully read this Release of Liability Agreement in its entirety.
• I understand its purpose and legal effect.
• I understand that I am giving up certain legal rights on behalf of myself and/or my minor child.
• I have had the opportunity to ask questions before signing.
• I sign this agreement freely and voluntarily without pressure or coercion.
• I understand that this agreement is a condition of participation in Diamond Dance Complex programs.
